The user, it’s you. Every customer who acquires goods uses services or browses the site.

Goods and services are all products, services, and information displayed at hmreny.com, both free and paid. These general terms and conditions apply to both types of services. Using some of the services requires online registration.

A contract under which the trader transfers or undertakes to transfer ownership of the goods to the consumer and the consumer pays or undertakes to pay the price for them, including contracts having as their object both goods and services.

The site of Start Ars Ltd. provides you with information about the activities, goods, services, and prices of HMReny, as well as access to our offers, news, and publications.

It also gives you the opportunity to make a purchase of all our goods and services.

Goods and services (or all of their functions) may vary by region and country. There is no guarantee that a particular Service or its function will be available to any User. HMReny may, in its sole discretion, restrict, deny, or create different levels of access to and use of any services and their functions in relation to different Users.

Registration

On the home page of the site, there is an entrance, from which everyone can register in HMReny, respectively with e-mail and password.

By registering, the user expresses “online” consent to these General Terms and Conditions, which is considered bound by their clauses.

No user registration is required to make a purchase, but it is required to familiarize and agree with the General Terms and Conditions and all their additions.

HMReny reserves the right to refuse user registration or deletion of such information in the event of providing inaccurate or inappropriate information by the user or registration for the purpose of abuse.

Order

Users use the site’s interface to enter into contracts with HMReny for the goods and services offered.

The user gets the opportunity to place orders by adding the desired goods to the shopping cart, following the steps to complete and send the order.

HMReny does not publish information on the availability of products and services sold.

HMReny also offers its users the option to order individually. You can contact us in your preferred way of contact.

After we make the product ordered by you, review it, and confirm your order, HMReny creates an individual product in the store, which you order electronically according to the standard order line.

The maximum term of production does not apply in cases for the production of the individual order of a client. Then the term is agreed once, specifically for the order, between the parties.

Adding goods to the shopping cart without completing the order does not result in the registration of this order or preservation of the goods.

Completing an order in 3 steps:

1. Filling in name and surname, contact phone number, e-mail, and address.

2. Fill in the delivery address.

3. Choice of payment method.

After placing an order, the HMReny team contacts the user for confirmation.

It is important that the user’s data is filled in correctly so that the request can be confirmed.

HMReny reserves the right to refuse an order in the absence of stock of a product or other reasons that prevent the execution of the order at the time and at the time of departure.

HMReny has the right at its discretion, without giving the notice to terminate the contract unilaterally, in case it finds that the services provided are used in violation of these General Terms, the legislation of the Republic of Bulgaria and generally accepted moral norms.

Except in the cases provided for in these General Terms and Conditions, the contract between the parties is terminated upon termination of the Merchant’s activity or termination of the maintenance of its website.

HMReny has the right to refuse to enter into a contract with an incorrect user. Anyone who does not comply with the general conditions of the site shows the incorrect, arrogant, or rude attitude towards the representatives of HMReny or systemic abuses by the user is considered an incorrect user.

An order can be made both by a user who is registered on the site and by a user who does not have a user profile.

Prices, method of payment

The prices of the goods and services are in Bulgarian levs (BGN), Euro (EUR), and Dollar (USD) with VAT included. The prices indicated in Euro (EURO) and Dollar (USD) is for clients from other countries. The exchange rate of the various currencies is determined by the BNB (Bulgarian National Bank) fixing for the day. The price announced for each product is valid for the respective package (quantity of uniform items in a single package), which depends on the type of product and DOES NOT INCLUDE delivery costs.

The prices of the offered goods are those indicated on the site at the time of placing an order, except in cases of obvious error.

HMReny reserves the right to change at any time and without notice the prices of goods and services offered on the site, and such changes will not affect orders already placed.

HMReny may provide discounts for the goods and services offered on the site in accordance with Bulgarian law and rules set by the Merchant. The rules applicable to such discounts are available where the discount is displayed. Discounts can be provided in various forms (for example – promotions, loyalty discounts, provided individually, at random, or as a result of participation in a competition or customer survey).

Different types of discounts cannot be combined when ordering and purchasing the same product.

The user can make a payment with PayPal, credit or debit card, cash on delivery or payment by bank transfer.

* Payment by cash on delivery is active and applicable only for orders that are on the territory of Bulgaria!

If the consumer chooses a payment method involving a third party (payment service provider), he may be bound by the terms and conditions and/or fees of that third party.

HMReny is not liable if a payment method involving a third party (payment service provider) is not available or otherwise does not work for reasons that cannot be determined to be dependent on HMReny.

Order cancellation and refund

Cancellation

Order cancellation can be made up to 12 hours from the moment of placing the order, but not after the latest confirmation and/or processing by HMReny.

PRODUCT RETURN AND REFUND.

Pursuant to Article 55, paragraph 1 of the CPA, a buyer who has the status of a consumer within the meaning of the CPA has the right to withdraw from a contract within fourteen / 14 / days from the date of acceptance of the goods. Without due compensation or penalty and without stating a reason, to withdraw from the contract by returning the ordered goods under the following conditions:

1. The consumer must inform HMReny in advance and unequivocally in writing to the following e-mail address: [email protected] that on the basis of Article 55, paragraph 1 of the CPA withdraws from the contract and undertakes to return the goods to the following address: Kazanlak, Gen. Skobelev ”№ 24.
2. To provide a bank account to which he will be reimbursed the amount paid by him for the returned goods.
3. When returning the refused product, it must be accompanied by the original purchase document (invoice and receipt), as well as the customer’s own and complete “Refusal form for online purchase”, which can be found here.
4. The goods must be returned personally by the consumer.
5. The goods must not be used, they must be in the form in which they were received. To be in its original packaging, in good commercial condition, and complete. The integrity of HMReny labels and stickers must not be compromised.
6. All transport and other costs for returning the goods are entirely at the expense of the consumer, until the return of the goods, the risk of accidental damage is borne entirely by the consumer.
7. When in connection with the performance of the contract the Merchant has incurred costs and the User withdraws from the contract, HMReny has the right to withhold the relevant amount for the costs incurred or to demand their payment.
8. In case the consumer exercises his right under Article 55, paragraph 1 of the CPA and in compliance with the above conditions, HMReny undertakes to refund the amount paid for the value of the goods, by bank transfer, within from 14 days after returning the goods.

HMReny has the right to withhold payment of the amounts in the event of withdrawal from the contract until it receives the goods.

A user may not exercise his right of withdrawal in the following cases:

1.When providing goods/services for which the consumer has given prior consent to waive his right to return, after the performance of the contract by HMReny.
2.When providing goods and services made to order for the consumer or according to his individual requirements.
3.Return of digital schemes, products, and services.
4.And all other cases valid according to Art. 57 of the Consumer Protection Act.

Delivery

HMReny uses the courier services of Econt and Bulgarian Posts. As Econt transports all our shipments that are on the territory of Bulgaria, and for international shipments, we use Bulgarian Posts.

Prices for Bulgaria

BGN 5 fixed price for delivery to an Econt office.

BGN 7 fixed delivery to your address.

Free delivery for orders over BGN 100.

* The condition for free delivery does not apply in cases of an individual order. Then the terms of delivery are agreed in advance between the parties and apply only within the given order.

Prices for international shipments

Europe

The delivery price for each shipment, including one product is 8 euros, and for each additional product, the same shipment is charged 2 euros.

Free delivery to Europe, the user uses when ordering over 100 euros.

* The condition for free delivery does not apply in cases of an individual order. Then the terms of delivery are agreed in advance between the parties and apply only within the given order.

USA and Canada

The delivery price for each shipment, including one product, is 10 dollars, and for each additional product, the same shipment is charged 2 dollars.

Free shipping to the US and Canada, the user enjoys when ordering over $ 100.

* The condition for free delivery does not apply in cases of an individual order. Then the terms of delivery are agreed in advance between the parties and apply only within the given order.

All orders received on weekdays are processed no later than the next day, but only after your confirmation. Orders received on Friday, Saturday and Sunday are processed on Monday, but only after your confirmation.

The shipment will be delivered to you within 1-3 working days. For all international deliveries 10-30 days, usually about 10 days. If delivery lasts longer than the specified time, please contact us.

Delays are possible depending on the courier’s schedule on holidays.

Complaints

All products in hmreny.com are new and handmade by HMReny.

Upon receipt of the goods, the consumer is obliged to inspect it immediately. In case it finds obvious defects, visible defect, damage caused during delivery, the discrepancy between ordered and delivered goods, lack of accompanying accessories or lack of documents required by Bulgarian law, immediately inform the person making the delivery.

If he fails to do so, the delivery is considered approved, and the consumer loses his right to request a complaint about any of the reasons listed above.

The consumer has the right to claim for any discrepancy of the goods or services with the agreed/ordered when after delivery, discrepancies are found with the sales contract.

Except in the following cases:

1.Color difference due to natural differences in color reproduction from different monitor models or differences depending on the individual setting of your display.
2. Natural wear and tear of goods.
3. The difference in the size of the goods up to 5 cm. All products in the HMReny store are made by hand and the sizes indicated for them are indicative due to the non-mechanized way of their production. Also, the materials from which HMReny products are made are of variable size.

Complaints can be filed only by the consumer who requested the product or service.

The consumer has the right to file a claim for the product or service, regardless of whether HMReny has provided a commercial warranty for the product or service.

When filing a complaint, the consumer can claim a refund, a discount, or repair/repair of the defect (HMReny can not replace the product ordered by you with another identical to it, as the goods are handmade and can always to have differences between them, albeit minimal).

Any non-conformity of the consumer goods with the contract of sale, which occurs within 6 months after the delivery of the goods, is considered to have existed at the time of delivery unless it is proved that the lack of conformity is due to the nature of the goods or the nature of the discrepancy.

The consumer may not contest the conformity of the consumer product with the contract for its sale when:

1. At the time of concluding the contract, he knew or could not have been unaware of the non-compliance.
2. The discrepancy is due to the materials provided by the user.

When filing a complaint, the consumer must also attach the documents on which the claim is based, namely:

1.Receipt of invoice.
2.Protocols acts, or other documents establishing the non-conformity of the goods with the agreed.
3.Other documents establishing the claim on the grounds and amount.

After agreeing on how to satisfy the complaint between the parties, which returns the product and its documents to HMReny.

Complaints of goods purchased through online stores are made according to the rules of the CPA and in accordance with the terms and conditions of their commercial warranty.

Complaints may be rejected in case of violation of the integrity of the goods and their packaging and labeling, any other damage caused by the consumer.

Force majeure circumstances

The parties are not liable for full or partial non-performance of obligations under the contract if it is due to “force majeure” (force majeure).

“Force majeure” (force majeure) means a circumstance (event) of an extraordinary nature, which occurred after the conclusion of the contract, could not be foreseen and does not depend on the will of the parties such as fire, industrial accidents, military action, natural disasters – storms, torrential rains, floods, hail, earthquakes, icing, drought, landslides, and other natural disasters, embargoes, government bans, strikes, riots, riots, etc.

The party that has been unable to fulfill its obligations due to a force majeure circumstance is obliged to notify the other party in writing within 10 days of its occurrence, as well as the presumed period of validity and termination of the force majeure circumstance.

The certification of the occurred “force majeure” is performed with a certificate of force majeure, issued by the Bulgarian Chamber of Commerce and Industry.

Website accessibility and limitation of liability

1. HMReny strives to make the site accessible 24 hours a day, every day of the week, without interruption and undertakes to make every effort to ensure that the exchange of information runs smoothly. Access to the Website may in some cases be suspended or restricted in order to perform repair and maintenance actions or to introduce new services or functionalities. 4. HMReny offers site users hyperlinks with which they can connect to third-party sites (external links, external links). HMReny does not control and is not responsible for the content of third-party sites to which such external links lead, including their methods of doing business or any products and services related to their sites.
5. HMReny makes every effort to ensure that the information provided on the website is accurate and up-to-date, and reserves the right to correct the content at any time and without notice. However, HMReny cannot guarantee that all information is accurate, complete, and current at the time the site is accessed.
6. The user warrants to HMReny that he will use the site in a lawful and fair manner in accordance with these GTC. In this sense, the consumer strongly undertakes not to interfere, including not to obstruct, violate or interrupt in any way, in whole or in part, incl. temporarily, the normal functioning of the site.
7. Where applicable, the User undertakes not to provide or publish on the site content that should be considered illegal, illegal, offensive, pornographic, racist, offensive, or obscene. HMReny reserves the right to take any steps or legal action it deems necessary to terminate such conduct.

HMReny’s intellectual property may not be used in any way without the prior written consent of HMReny.

Images on the HMReny website and other visual elements constituting HMReny’s intellectual property may not be copied, used, or reproduced in any way by third parties without the prior written consent of HMReny.

Any unauthorized use of the materials published on the site without the permission of HMReny is a violation for which the violator bears civil, administrative, and criminal liability in accordance with applicable Bulgarian law.

HMReny does not authorize the use in any way of the content of the site, by visualizing all or part of the materials, offers, or images published in it, in another site, including in the frame.framing of elements. References to materials on the Site, from other sites, are permitted if they are made in accordance with good morals and commercial practice and if the reference and the manner of presentation of the reference do not raise doubts about the authorship of HMReny on the materials so that users are not misled.

Rescue clause

The Parties declare that in the event that any of the clauses of these General Terms and Conditions prove to be invalid, this will not invalidate the entire contract or other parts thereof. The invalid clause will be replaced by the mandatory norms of the law or the established practice.

Settlement of disputes between the parties

1. The parties will resolve any disputes that have arisen between them by mutual agreement.
2. If the agreement between the parties proves impossible, all disputes arising out of or relating to the performance of this Agreement, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes concerning the filling of gaps in the contract, or its adaptation to emerging circumstances, will be referred for resolution to an ADR body or the European online dispute resolution platform- here.
